Use this notice when your tenant hasn't paid rent on time.
When to use the N4
You can serve an N4 notice when:
- Rent is due but hasn’t been paid
- You want to begin the eviction process for non-payment
- The tenant has no valid reason for withholding rent
Important: You don’t need to wait for rent to be late by a certain number of days. You can serve an N4 the day after rent is due.
How the N4 works
1. Serve the notice
Give the tenant the N4 notice with the correct termination date (at least 14 days from service).
2. 14-day waiting period
The tenant has 14 days to pay the rent owed in full. If they pay everything, the notice is “voided” and the tenancy continues.
3. If not paid in full
You can file an L1 Application with the LTB to evict and collect the rent owed.

Calculating the termination date
The termination date must be:
- At least 14 days after you serve the notice
- The day before a rent payment is due (usually the last day of a rental period)
Example: If rent is due on the 1st and you serve notice on January 15th:
- 14 days from January 15th = January 29th
- But termination date should be the last day of the rental period = January 31st

- Rental unit address — Full address of the unit
- Tenant name(s) — All tenants on the lease
- Landlord name and address — Your contact info
- Termination date — Calculated correctly (see above)
- Amount owed — Total rent arrears broken down by period

After serving the N4
If tenant pays in full
The notice is voided. You cannot proceed with an L1 application for this notice.
If tenant doesn’t pay
You can file an L1 Application with the LTB. You’ll need:
- Copy of the N4 you served
- Proof of how you served it
- Calculation of rent owed
- Copy of the lease (if available)
