Notice to End a Tenancy for Interference or Damage

Use this notice for noise complaints, disturbances, or tenant-caused property damage.

When to use the N5

You can serve an N5 notice when your tenant has:

  • Substantially interfered with the reasonable enjoyment of other tenants or the landlord
  • Caused damage to the rental property beyond normal wear and tear
  • Created unsafe conditions
  • Engaged in noise disturbances

Important: The interference or damage must be substantial, not minor or occasional issues.


Two types of N5 notices

First N5 (Can be voided)

  • Notice period: 20 days
  • Can tenant void? Yes—by correcting the problem within 7 days
  • Use this for a first offence

Second N5 (Cannot be voided)

  • Notice period: 14 days
  • Can tenant void? No
  • Use this if tenant has received a first N5 in the previous 6 months and the issue happens again

How the N5 works

1. Serve the first N5

Give the tenant the N5 notice describing the interference or damage.

2. 7-day correction period

For a first N5, the tenant has 7 days to:

  • Stop the interfering behaviour, OR
  • Repair the damage, OR
  • Pay for the damage

3. If problem continues or isn’t fixed

You can file an L2 Application with the LTB to evict the tenant.
